Official Dispatch 28690/SLDTBXH-VLATLD (2024) of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City instructs the submission of reports on labor use situation in 2024 with the main contents:
Deadline for submitting reports:
- Before December 5, 2024.
- After this deadline, the Department of Labor, Invalids and Social Affairs will not receive reports and may handle administrative violations according to Decree 12/2022/ND-CP.
Report submission form:
- Through the National Public Service Portal: https://dichvucong.gov.vn/.
- Online at Ho Chi Minh City Department of Labor, Invalids and Social Affairs: Google Form Link https://forms.gle/oqUdAUkzCrDpdY1J9.
Penalty for not submitting reports:
- According to point c, clause 2, Article 8 of Decree 12/2022/ND-CP:
- Fine of 5-10 million VND for individuals who commit one of the following acts:
– Discrimination in labor, except for discriminatory acts specified in Point d, Clause 1, Article 13, Clause 2, Article 23, Clause 1, Article 36 and Clause 2, Article 37 of this Decree;
– Using workers who have not been trained or do not have a national vocational skills certificate for occupations and jobs that require the use of trained workers or must have a national vocational skills certificate;
– Failure to report labor changes according to regulations;
– Failure to prepare a labor management book or preparing a labor management book not on time or not ensuring the basic contents according to the law.
The fine is doubled for businesses. Businesses need to comply with regulations to avoid violations and related sanctions.
